Contract Strategy, Procurement & Execution Support
We support owners and developers of complex CAPEX projects in defining and implementing procurement and contract strategies that are aligned with their objectives, constraints, and market realities.
Rather than starting from a standard contract form, we work with our clients through structured workshops and decision frameworks to determine the most appropriate contracting and procurement approach for each project. Our support spans the full lifecycle from early strategy definition, tendering and market engagement through contract drafting, negotiation, and execution support.
How it works
We begin with structured strategy workshops involving key project stakeholders. Using KQi’s in-house contract strategy matrix, we assess project objectives and constraints such as risk appetite, delivery model, market conditions, interface complexity, financing requirements, and internal capabilities.
Based on this analysis, we define the most suitable contract and commercial strategy, including the recommended contracting model, risk allocation principles, and governance setup.
What we do
- Facilitate contract strategy and procurement workshops
- Define contracting models (EPC, EPCm, Owner-Integrated, Two-Stage, Alliance, hybrid models)
- Develop risk allocation and liability frameworks aligned with market appetite
- Advise on FEED-to-EPC rollover strategies and pricing mechanisms
- Establish contract governance, roles, and decision frameworks
- Align contract strategy with schedule, cost, and execution realities
How it works
We translate the agreed contract strategy into a clear and executable procurement plan. This includes packaging strategy, market engagement, tender processes, and evaluation methodologies, ensuring alignment between technical, commercial, and contractual objectives.
We support clients throughout the procurement phase, from preparation of tender documentation through bid evaluation and award.
What we do
- Define procurement and packaging strategies
- Support market sounding and early contractor involvement
- Prepare and review tender documentation and commercial schedules
- Set up evaluation criteria and governance for tender assessments
- Support bid clarification, alignment, and recommendation to award
- Advise on procurement risks, interfaces, and mitigation measures
How it works
Once the contract strategy is defined, we lead or support the drafting and negotiation of project contracts, ensuring consistency with the agreed risk allocation and procurement objectives. We focus on clarity, enforceability, and practical execution, avoiding unnecessary complexity.
Our experience spans FIDIC, NEC, JCT, and bespoke forms, including open-book, target price, and reimbursable structures.
What we do
- Draft and tailor contracts and commercial conditions
- Align general conditions with project-specific risk profiles
- Support commercial and contractual negotiations
- Advise on liability caps, exclusions, and interface provisions
- Define change, variation, escalation, and claims mechanisms
- Ensure contracts are execution-ready and fit for purpose
How it works
Effective contract management starts before the contract is signed. KQi supports clients in setting up pragmatic, project-specific contract management frameworks from Day 1, aligned with the chosen contract strategy, delivery model, and governance structure.
We focus on clarity, discipline, and early intervention. Our approach ensures that obligations, risks, and changes are managed proactively during execution, rather than reactively once issues escalate into claims or disputes.
What we do
- Set up contract management frameworks tailored to the project and contract model
- Define roles, responsibilities, and governance for contract administration
- Establish change management, early warning, and notification processes
- Develop practical tools: contract registers, correspondence protocols, and trackers
- Support valuation, variation, and time impact processes during execution
- Act as owner-side commercial counterweight during contractor interactions
- Support negotiations and resolution of issues before they escalate into disputes
- Define change, variation, escalation, and claims mechanisms
- Ensure contracts are execution-ready and fit for purpose
What sets us apart
KQi combines strategic thinking with hands-on delivery experience. We do not offer one-size-fits-all solutions or start from a preferred contract form. Instead, we help clients make informed decisions by balancing risk, control, market appetite, schedule, and cost certainty.
Our team has deep experience across FIDIC, NEC, and JCT forms of contract, as well as bespoke and hybrid models, and we remain actively involved through execution to ensure that the chosen strategy works in practice, not just on paper.
